Approval of Minutes

February 2012 meeting minutes were approved.

Area 1 Safety & Security

Annie Sloan distributed a listing of reported crimes for Beats 1X, 2X, 2Y, 5X, 5Y, 6X and 7X,
covering the past seven days. Area 2Y has experienced increased vandalism recently, most likely
graffiti-related. Other crime incidents in West Oakland included stolen vehicles, assault, robbery,
prostitution and trespassing. Theft of Honda’s and Toyota’s are more prevalent than other
vehicles – Annie has safety locks available for distribution for those who contact her.

Business managers and employees should be careful about carrying cell phones, which are a
target for thieves along with items left behind in vehicles. Michael Herling noted that a code
exists to disable cell phones, even when the battery is dead; Michael will locate the information to
get it distributed.

In responding to a question, Officer Buford reported no recent arrests for illegal dumping have
been made, to his knowledge. Dumpers are difficult to catch because they operate at night, in
the dark, and quickly. Dumpers are strategic in where and how they dump to avoid being cited or
caught in the act.

Michael pointed to ongoing copper and metal theft as an issue that needs to be addressed by
OPD. Officer Buford indicated that, overall, West Oakland is relatively safe and crime statistics
are low for the area. OPD’s main focus is on resolving and preventing robberies. The
Department is in the third phase of the 100 Block Initiative being promoted by Mayor Quan.
Margot Prado suggested that a commercial survey be conducted to gauge problems occurring in
the area.

Dexter English of City of Oakland reported on his work with three local homeless encampments
that present a health and safety issue. Dexter continues to offer alternatives to the homeless
upon his visits to the encampments. Michael also reported on distribution of referral service
contact information, though his efforts have been met with non-response by the homeless
individuals he’s encountered.

Status of Railroad Right of Way Issues

George Burtt provided background on the issues of area rail maintenance and prior meetings
conducted with both UP and BNSF. John Palacios of BNSF reported on contacts made with
internal Texas staff in determining property lines, after a response from Southern California staff
was insufficient. John recently met with UP managers but will also have future meetings with
them to discuss responsibility for Oakland rail maintenance. Margot Prado of City of Oakland
noted that rail in question is not being used. A prior study commissioned by City of Oakland and
conducted by BKF Engineering cited priority areas where rail should be addressed; Margot will
share the report with John and UP staff. George discussed last summer’s effort to prioritize
locations needing improvement, including Union, 26th Street, 18th, etc. Photos and maps were
provided at that time to the rail companies.

Margot discussed a conference she will be attending, hosted by the US Department of Commerce
that may be a source of funding for capital improvements. She recommended a joint partnership
between the City and rail companies in applying for a federal capital grant to improve conditions.
Priority areas are already known, as noted in the infrastructure study produced by BKF. Margot
noted transportation planning efforts being made between Emeryville and Oakland. The linkage
between Emeryville and Oakland may serve to assist in getting the rail issues in West Oakland
resolved.

Michael Herling conveyed the need to attract new business to the area; having streets that are
aesthetically pleasing and easy to navigate is important when showing prospective tenants a
property.

John noted that UP has a franchise agreement with the City of Oakland while BNSF does not.
Margot offered that the rail issue should be advanced with Assistant City Administrator Fred
Blackwell.

George read from October 2011 BusinessAlert minutes in noting UP’s assessment of rail
ownership in the area:

  • Poplar to Louise = Oakland Terminal Railroad (OTR), owned jointly
  • 26th, Wood to Chestnut = owned jointly, BNSF and UP
  • 20th, Wood to Poplar = BNSF
  • 18th, Wood to Poplar = Old Red Train line, Southern Pacific (SP acquired by UP)
  • Concrete panels on Mandela = needs further research
  • Wood Street, Emeryville to 18th Street = BNSF

Michael noted action items going forward:

  • Margot will provide priority sites to BNSF staff
  • BNSF will work internally with Texas staff to better understand property lines and responsibility
  • The idea of doing one street as a pilot should be posed
  • BNSF is to seek capital funding for 2013 projects

John was thanked for BNSF’s accomplishments last year in removing debris from its property.

Haz Mat Dumping – City Pick Up Policy and Procedure

George Burtt shared photos of haz mat dumped on a West Oakland street and conveyed that the
services being offered for haz mat pick-up are unacceptable and inadequate. Dexter English
responded that haz mat is being made a priority matter by the Mayor, and a new fire chief may
also make a positive impact in the way in which materials are handled. The goal is to reduce the
gap between when haz mat is dumped and reported, and the time of pick-up.

Public Works Agency (PWA) is not allowed to pick up haz mat, as it is not qualified to do so. The
Oakland Fire Department is the entity charged with picking up haz mat materials. George
discussed the lack of a cohesive system for picking up haz mat. A joint effort between PWA and
Oakland Fire Department should be implemented. Dexter reported that a plan is currently being
made to address pick up in a much quicker and more efficient manner. The goal is to pick up all
haz mat materials once determined it is safe to do so. PWA would be in violation of various
regulations in picking up haz mat, and may be put in danger by not knowing what exists the in the
containers being picked up.

Leroy Griffin reported on haz mat pick-up from the Oakland Fire Department standpoint. Oakland
Fire Department has a tracking system in place for haz mat pick-up. Haz mat pick-up is
expensive in that a company engine is taken out of service for every pick-up, costing thousands of
dollars for every gallon of haz mat processed. As budgets tighten, it has become a challenge to
locate a funding source for haz mat pick-up. When first initiated, the haz mat program was meant
for large scale accidents, such as tanker overturns, not for household pick-up’s. Most pick-up
(90%) now consists of oil dumped by local residents doing oil changes, or dumped paint.
Springtime (after spring cleaning) and at Christmastime are peak haz mat dumping periods.

Leroy discussed a fine that was levied against the City of Oakland because Oakland Fire
Department had not been following proper procedure in picking up haz mat. Oakland Fire
Department needs to get recertified for pick-up. The goal will be to pick up haz mat within 24
hours of being notified of dumping. Those who pick up haz mat need to be specially-trained and
OSHA-certified. Materials need to be dropped off at a certified haz mat facility (on Edgewater
Drive) and a receipt issued. Ultimately, haz mat is picked up by a contractor out of Ogden, Utah.
Leroy noted that warning signage and dummy cameras are an important tool in deterring
dumping. Cameras have proved to be an effective deterrent on Railroad Avenue in East Oakland.

Both Leroy and Dexter emphasized that haz mat pick-up response will improve shortly, as State
recertification is in process and the Mayor’s Office has made haz mat a higher priority. George
urged that PWA and Oakland Fire Department work together more closely, with improved
communication, so that haz mat is handled in a fast and efficient manner. Tim of Bay Alarm
agreed to share license plate data with PWA and Oakland Fire Department of dumpers the
company documents. Leroy welcomes the opportunity to return to West Oakland BusinessAlert in
April to discuss progress.

Illegal Dumping Deterrent System

The contract for the deterrent system as implemented by Bay Alarm is set to expire in September.
As a City budget is now being formulated, discussion about the continuation of the deterrent
system needs to occur. Quantifiable statistics are needed by City of Oakland as to the
effectiveness of the system in deterring dumping.

New Business

George noted the West Oakland Specific Plan does not address issues discussed at today’s
meeting. Margot agreed that Ettie Street and the flood control issues occurring there need to be
incorporated into the Plan, as well as area lighting and street surfacing. As BusinessAlert is
focused primarily on crime and security matters, how topics relating to the Specific Plan are to be
included at this meeting will need be determined.

Area 1 Safety & Security Update – Discussion with Captain Steven Tull

Captain Tull will be provided with a list of West Oakland business owners who wish to be contacted by
OPD in regards to safety and security issues, including recent metal theft. Captain Tull’s intent is to
meet with every business owner on a regular basis who wants contact. Beat officers should also be
meeting with owners – if this is not occurring, Captain Tull will ensure that it gets done, even if just a
quick stop into the business to check in. The number of PSOs is back to 57, from 35 previously in
service in this position around the city. Captain Tull wants each business owner to know his or her
PSO and beat officer. Each officer has email and some have business cards that can be given out on
visits. Captain Tull asked that he be kept abreast of whether officers are making stops so that he is
updated. The Captain stated there is enough time in the day for officers to make quick visits with area
business owners. Roberto Costa will work with Captain Tull to provide a list of area PSO’s.

Redevelopment’s end will most likely not impact patrol in West Oakland. Walking and NET
(Neighborhood Enforcement Team) officer positions previously funded by redevelopment were saved.

The elimination of violent crime was Chief Batts’ main focus. Acting Chief Jordan is employing a
strategy that also puts attention on property crime as well, including metal theft that costs business
owners money.

Captain Tull was encouraged to promote OPD’s membership in scraptheftalert.com. Ed Kangeter of
CASS discussed his company’s involvement with the organization and the manner in which CASS
screens materials before acceptance. Ed urged OPD visits to area recycling operations and
partnership with responsible recyclers so that receipt of stolen material is discouraged. Steve Lowe
suggested the use of Bay Area Air Quality Management resources to monitor recycling operations,
since OPD resources are limited. The use of fences to sell stolen goods is an ongoing problem that
needs to be addressed but that also requires resources currently not available. CASS takes measures
to identify who it’s doing business with, including obtaining a picture ID. Staff at the company has
been threatened for not buying what it considers to be stolen metal. The company keeps a customer
history database and also delays some payment to ensure the legitimacy of transactions.
Transactions conducted from a shopping cart are not accepted. Ed urged a better coordinated effort
by both recyclers and OPD, that opportunities to collaborate be exploited. AT&T and PG&E should also
become involved in this discussion. Captain Tull agreed to sign up for scraptheftalert.com and have
PSO’s make stops at recycling centers where metal theft buys are occurring.

New Alert Service Offered by OPD

Nixle.com is a new nationwide email alert system being used by OPD to notify citizens and
business owners throughout Oakland of crimes that have occurred. Users of Nixle receive email
notification of criminal activity and selected arrests shortly after they happen. A user can register
to receive notifications for a particular beat or beats. Nixle offers a way to keep up to date on
area crime. Other alerts are also issued through Nixle, such as Occupy Oakland protests and
other activities that may impact the safety of Oakland residents. George Burtt attested that Nixle
is free and easy to use. Alerts are issued over Captain Tull’s signature.

Illegal Dumping Deterrent System

Tim Morse described how the Bay Alarm camera deterrent system caught a perpetrator in the act
of dumping. The company has been told that OPD does not dispatch for illegal dumping. Captain
Tull has heard similar complaints and considers this a dispatch problem and will meet with the
dispatch commander soon. Calls are designated A, B and C levels of urgency. Oftentimes
dispatch does not recognize the nexus between violent crime and property crime, a problem that
needs to be fixed within OPD. Overall, Captain Tull is not an advocate of having citizens complete
online forms because he believes it diminishes the level of service provided by OPD. He agreed
to inform dispatch of the relationship that exists between Bay Alarm and Oakland Public Works.
When Bay Alarm contacts OPD in regards to illegal dumping, it should inform dispatch of its
relationship with OPW to receive expedited service.

Captain Tull discussed dispatch of incoming calls. OPD receives approximately 4,000 calls for
service a week. Domestic violence calls account for many of those received and receive priority,
along with robbery, homicide and other calls involving violent crimes. Captain Tull stated that
OPD’s 9-1-1 system does not get as many improper calls as might be suspected (calls unrelated
to law enforcement), however it does receive many calls that could be handled on a nonemergency
basis, which impacts the overall level of service to the public.

Tim reported that three cameras have been relocated and one left in place. Cameras are on a
timer system, turned on at 6 a.m. and off at 4 p.m. Cameras will be re-tuned as needed.

Outcomes

Today’s meeting will be followed up by email with three or four key bullet points to be addressed.
To gauge progress on priority items discussed, Captain Tull will be invited back to the next
BusinessAlert meeting.

George Burtt will distribute a survey that queries business owners about a potential visit by OPD,
i.e. “Would you like OPD to stop by?” The survey will mention Captain Tull’s support of visits to
local businesses.

Status of Railroad Right of Way Issues

George is in communication with Andy Perez of UP, who conveyed that BNSF needs to be
engaged before further progress can be made on right of way issues. Both rail companies will be
invited to a future meeting.

New Business for Next Meeting

Nathan Rapp has not responded to a follow-up email inquiry on the mattress redemption issue.
A report on Michael Herling’s visit to Trapeze Art will be provided.
The topic of proper hazmat handling will be added as a future agenda item. Leroy Griffin will be
contacted in this regard.

October 2011 meeting minutes were approved.

Safety and Security Forum

Tim Morse of Bay Alarm described recent strong-armed construction site robberies occurring at
Dogtown Development. Robbers approach during working hours and order workers to lie down and
give up belongings such as wallets and watches. OPD has been made aware of these crimes
occurring at three different job sites, and word has gotten out to local workers to be prepared. Police
response was not sufficient in that, in at least one instance, OPD did not arrive until three days after
being called for service.

Statistical maps will be provided next month for the last 56 days of reported criminal activity. The
crime trend appears to be up for the end of 2011.

Metal Thefts

Neither invited OPD command staff nor an officer representative was in attendance at today’s meeting
to discuss area metal theft. Committee members noted that OPD officers have not been in
attendance at BusinessAlert meetings in several months. Their attendance is especially important in
light of the brazen construction site robberies. Committee members discussed the lack of OPD
presence at area meetings. Captain Tull and/or Captain Israel should be engaged to address the
sporadic representation, particularly since it appears PSOs are no longer available to attend while
crime and quality of life issues persist. It was noted that PSOs regularly attend local NCPC meetings.
Roberto Costa reported his understanding that OPD does not have responsibility to have a PSO
present at West Oakland BusinessAlert. Al Saroni reported his dissatisfaction with a recent call for
service for which OPD took 12 hours to respond to a robbery in progress at the company. Emails to
OPD went unanswered.

Marcus Johnson expressed his opinion that the strength for fighting crime lies within the business
community itself, not necessarily in reliance upon OPD. OPD is operating with a skeleton crew in the
midst of Occupy Oakland activities. A recent NCPC meeting had upwards of 40 people in attendance
without OPD representation. Discussion focused around a sexual assault that had occurred the week
before. The group made the best of the situation by brainstorming and seeking solutions to become
safer and more observant. OPD does not necessarily need to be a participant in all meetings – there
are things the business community can do to help itself.

George urged that a meeting with Captain Israel be scheduled to discuss crime in West Oakland and
officer attendance at BusinessAlert. The status of officers designated through WOPAC needs to be
addressed as well as the funds allocated for their deployment. The question of whether West Oakland
BusinessAlert is an NCPC can also be answered by Captain Israel. Cookie noted there is a mechanism
that exists for tracking funding and its use, and that the project manager who oversees the funding
should be contacted. Steve Lowe stated that every business in West Oakland should have the
designated officers programmed into phones and that officers funded by redevelopment should be
accessible through a direct telephone number. Ray Kidd’s research indicates that the last West
Oakland BusinessAlert meeting attended by designated OPD officers was August of 2010. The fact
that OPD officers would no longer be attending meetings was not brought to the attention of West
Oakland BusinessAlert.

Personnel shifts within OPD without notification to the public is a problem to be addressed, as is
continuity. Officers designated for West Oakland need to be identified, non-responsiveness needs to
be addressed, as does representation at area meetings.

Al Saroni reported theft from his roof, a 7-foot piece of copper removed that resulted in 900 lbs. of
Freon gas worth $50,000 being released into the atmosphere. Now the company is going to great
lengths to coat its copper with Henry’s 208 black tar and wrap it in fiberglass to discourage theft. Tim
Morse recommended that companies also identify and mark copper with a company name, i.e. “stolen
from….” Al noted that copper must be clean when presented to a recycling center for sale – tar will
not only disguise the copper, but make it unattractive to thieves as well. CASS was cited recently on
Channel 7 as one of the few recycling centers that came out of an undercover operation involving the
attempted sale of disallowed materials well. Alliance Recycling, on the other hand, was recently cited
in a sting operation that may result in the revocation of come component of its licensing.

Illegal Dumping of Mattresses

Nathan Rapp of Senator Loni Hancock’s office described efforts being made to eliminate mattress
dumping in Oakland. It’s important to develop a strategy to get mattress manufacturers on board and
part of a redemption program that also involves retailers that sell mattresses. One model that might
be followed is currently being implemented in Minnesota – state elected officials there are delivering a
mattress disposal program they are confident will pass and be made into law. There are currently two
California bills that deal with the recycling of solid waste materials, AB1019 introduced by John Perez
dealing with a carpet tax, and SB515 from Ellen Corbett, still in appropriations, that deals with battery
stewardship. Nathan emphasized that when a bill is developed in regards to mattress disposal and
redemption, it will have to have teeth in order to be effective. George Burtt discussed that mattresses
need to be given a value so that they are not dumped but rather there is incentive for their
redemption. A value of $2 will not work, and $20 might be punitive to the consumer. Nathan agreed
that coming up with an appropriate value will be a challenge. The Minnesota program will be
monitored by the senator’s office. George emphasized that the mattress problem should be termed
as a California problem, not a manufacturer or retailer problem. Nathan noted the philosophical
question being debated at the moment is whether incentives or punishment presents the better
avenue for dealing with this issue.

Tim Morse will provide the senator’s office with photos of dumped mattresses that can be used in
support of the argument to be made for a redemption program. Cookie Robles-Wong will provide
statistics in regards to the number of mattresses being picked up in Oakland on a routine basis by
OPW. Tim will also contact Waste Management to see if there is a way for the company to become
involved in supporting needed legislation.

Status of Railroads (BNSF and UP) Code Compliance Issues

UP continues to work with West Oakland BusinessAlert in sorting out the various entities that own rail
in the area and will most likely attend the January meeting with an update. UP representatives are
scheduled to meet with Jocelyn Combs in early January for a regularly-scheduled quarterly meeting to
discuss rail in Oakland.

Review of Current Code Compliance Cases and Blight Program Implementation

Marcus Johnson noted that code compliance signs, as discussed at last month’s meeting, have been
posted around the area. Committee members commented about Trapeze Arts on 9th Street at the
Caltrans site, where children and young adults have been seen out late at night in the area, which
presents concerns for their safety. Michael Herling will visit the site to introduce himself and let the
business know of the security issues being experienced in the area.

Illegal Dumping Deterrent System

Cookie Robles-Wong provided a chart depicting camera efficacy as it relates to the illegal dumping
deterrent system recently implemented in West Oakland, a first report of findings that shows the
cameras are having a positive impact on discouraging dumping in the test areas of 9th, 16th, Wood
Street and Louise. Tim Morse and Cookie will convene a meeting soon to consider whether moving
one or more cameras is prudent, and report back at a future meeting.
